Amendments to Washington County, Iowa, Subdivision and Platting Ordinance as Adopted April 29, 2008

The following sections of the Washington County Subdivision and Platting Ordinance have been amended and approved by the Land Use and Planning Commission and the Washington County Board of Supervisors:

REVISIONS TO SUBDIVSION AND PLATTING ORDINANCE OF WASHINGTON COUNTY, IOWA
CHAPTER 45

45.05 EXEMPTIONS. The following subdivisions of land or transactions shall be exempt or partially exempt from the provisions of this Ordinance:

5. The division of land into parcels of one-quarter (1/4), one-half (1/2) or forty (40) acres or more (aliquot part) not involving any new street, easement or other dedication.

9. First Split Rule: In accordance with Chapter 354 of Iowa Code, whenever an original forty (40) acre quarter-quarter (aliquot part) has never been split or subdivided since the effective date of the Original Subdivision Ordinance (May 12, 2005), the creation of one additional parcel from the quarter-quarter through a plat of survey shall not be considered a subdivision. However, any subsequent split, or any split that involves the creation of more than one (1) parcel shall be considered a subdivision.

45.11 DEFINITIONS
Plat of Survey: The graphical representation of a survey of one (1) or more parcels of land, including a complete and accurate description of said parcel, prepared by a licensed land surveyor, creating no more than one new parcel.

Property Line Adjustment: Adjustment of boundary line(s) between two abutting lots or parcels and all property ownership remains with the abutting owners. Newly adjusted parcels are not to exceed an addition of more than fifty percent (50%) of the original parcel.

Subdivision: The repeated or simultaneous dividing of a tract, lot, or parcel of land into two or more parts, for immediate or future sale, transfer or building development. The term includes re-subdivision and, when appropriate to the context, shall relate to the process of subdividing or the land subdivided.

A. Major Subdivision: All subdivisions involving the creation:
1)Six (6) or more lots without improvements, fronting on an existing street.
2)Two (2) or more lots requiring major improvements including streets.

B. Minor Subdivision: A subdivision, re-subdivision or new parcel fronting on an existing street and not requiring any new major improvements and not adversely affecting the remainder of the parcel or adjoining property containing two (2) to five (5) lots total.

45.23 SUBMISSION REQUIREMENTS FOR ALL PLATS
45.23.4 In addition to the paper copy, any additional data as requested by the county in a digital format when available to assist in the accurate platting process.

F. Detail the location and width of any access easement. Permanent access and/or driveway easement must be noted and described on plat and by separate recorded document if newly created parcel does not abut current public roadway.

FINAL PLAT PROCEDURE

P. The coordinate system used for all GPS data as well as the GPS coordinates for the corner boundaries of the survey as well as any monumentation tied to.
