Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Boardroom at 5:34 p.m. Members present: V Fixmer-Oraiz, Jon Green, Lisa Green-Douglass*, Royceann Porter, and Rod Sullivan.

Unless otherwise noted, all actions were taken unanimously.
PUBLIC COMMENT
The following people asked the Board to issue a resolution to show support to Palestinians, urge peace in Gaza, and call for a permanent ceasefire in Palestine and Israel: Deema Totah, Dani Misyuk, Dan Phillips, Rima Afafi, Adrian Sandersfeld, Ed Flaherty, Razzi Abuissa, Mallory Hellman, Mona Odeh, Maureen McCue, Maher Josephenson, Mazahir Salih, Perry Lerz, and Casey Horwood.

DR. MARTIN LUTHER KING, JR. DAY
JANUARY 15, 2024
Summary: The King Holiday and Service Act, signed into law in 1994, established Martin Luther King, Jr. Day as a national day of service, encouraging individuals of all backgrounds to unite in service to their communities and embody the spirit of compassion and solidarity that Dr. King exemplified throughout his life. Board Action: The Board joins governments across the country to proclaim Monday, January 15, 2024, as Martin Luther King, Jr. Day in Johnson County and urge all people commemorate this day by engaging in acts of service, promoting equality and justice, and reflecting on Dr. King’s teachings to further the cause of peace, unity, and understanding among all people. Motion by Porter, second by Fixmer-Oraiz, to approve Proclamation No. 01-11-24-01. The following persons spoke: Mazahir Salih, Roger Musala, Ayman Sharif, and Charlie Eastham.

Motion by Porter, second by Fixmer-Oraiz, to approve the minutes of the Formal Meeting of January 4, 2024.
Motion by Fixmer-Oraiz, second by Green, to approve the payroll authorizations submitted by department heads and elected officials, as approved by a majority of the Supervisors.
Motion by Green, second by Porter, to approve the application for Alcohol License for The Tipsy Travelers as contained in the agenda packet for this meeting.
Convened Public Hearing at 6:44 p.m. on Zoning Application PZC-23-28445 of Susan and Rich Young, requesting rezoning of 20.91 acres from A-Agricultural to AG-T-Agritourism. The property is located at 2625 Highway 1 SW, approximately 3,700 feet southwest of Gingerich Road SW, in a portion of the SW 1/4 of the SW 1/4 of Section 33, Township 79 North, and a portion of the NW 1/4 of the NW 1/4 of Section 4, Township 78 North, all Range 7 West of the 5th P.M. in Union and Sharon Townships, Johnson County, Iowa.
Planning, Development, and Sustainability (PDS) Planner Joseph Wilensky reviewed the application. Susan Young of Lucky Star Farm was present to answer questions. No one from the public spoke. Public Hearing closed at 6:49 p.m.
Motion by Green, second by Fixmer-Oraiz, to waive the requirement of three considerations before approving an ordinance amending the Johnson County Unified Development Ordinance, Zoning Application PZC-23-28445. Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Porter, Sullivan.
Motion by Green, second by Porter, to approve the proposed ordinance associated with Zoning Application PZC-23-28445 on first and second consideration. Roll call: Aye: Fixmer-Oraiz, Green, Green-Douglass, Porter, Sullivan.
Convened Public Hearing at 6:51 p.m. on Zoning Application PZC-23-28446 of Hertz Farm Management, requesting rezoning of 1.17 acres from A-Agricultural to R-Residential. The property is located at 5685 Wapello Avenue SE, approximately 2,300 feet south of 560th St SE, in the SE 1/4 of the NE 1/4 of Section 35, Township 78 North, Range 5 West of the 5th P.M. in Lincoln Township, Johnson County, Iowa.
PDS Planner Joseph Wilensky reviewed the application. Mark Stein of MMS Consultants, Inc., was present to answer questions. No one from the public spoke. Public Hearing closed at 6:53 p.m.

RESOLUTION NO. 01-11-24-01
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND
SUBDIVIDER’S AGREEMENT OF SEEBECK SUBDIVISION, JOHNSON COUNTY, IOWA
Summary: Application PZC-23-28447, the preliminary and final plat of Seebeck Subdivision, Johnson County, is submitted for approval. Board Action: Approved the plat, directed the plat and Subdivider’s Agreement be signed, and named the documents to be recorded. Motion by Green, second by Porter, to approve Resolution No. 01-11-24-01 effective January 11, 2024.
RESOLUTION NO. 01-11-24-02
RESOLUTION SETTING A PUBLIC HEARING ON A PROPOSED FRINGE AREA POLICY AGREEMENT BETWEEN JOHNSON COUNTY, THE CITY OF SWISHER, AND THE CITY OF CEDAR RAPIDS
Summary: Johnson County, the City of Swisher, and the City of Cedar Rapids entered into a 28E Agreement in August 2004 pertaining to the Joint City / County Fringe Area. Staff of the County and the Cities have developed a draft new agreement to supersede and replace the August 2004 fringe area agreement. It is necessary to set a Board meeting date to take action on the new Fringe Area Policy Agreement with the Cities of Swisher and Cedar Rapids, and to give notice. Board Action: 1. This Board shall meet on January 25, 2024 at 9:00 a.m. CT in Room 203 C, Johnson County Health and Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, at which time and place a hearing will be held and action may be taken to enter into the proposed fringe area policy agreement between Johnson County and the cities of Swisher and Cedar Rapids; and 2. Auditor is hereby directed to publish the official notice of the hearing no less than four (4) and no more than twenty (20) days prior to the same. Motion by Fixmer-Oraiz, second by Porter, to approve Resolution No. 01-11-24-02 effective January 11, 2024.
Motion by Porter, second by Fixmer-Oraiz, to approve the Second Amendment to the Fiscal Year 2023 Juvenile Justice and Youth Development Program Agreement with the University of Iowa on behalf of the Rape Victim Advocacy Program, Iowa City, modifying the end date to December 31, 2023, decreasing the funding to $10,175, and no renewal option.
Motion by Green, second by Fixmer-Oraiz, to approve the Policy Development and Review of County-Wide Policy, as contained in the agenda packet of this meeting, effective January 11, 2024.
Motion by Porter, second by Green, to approve the Employee Assistance Program (Synchrony) Employee Service Contract with Synchrony Employee Assistance Program, Iowa City, for the Johnson County Employee Assistance Program, in an amount of $11,850.
Motion by Fixmer-Oraiz, second by Porter, to approve the letter of support regarding the Rural Autonomous Vehicle Program matching funds, as contained in the agenda packet of this meeting. Green noted this match funding is not an additional expenditure of Johnson County Secondary Road funds. Sullivan noted the vehicles, while autonomous, will have two drivers when in operation.
