Chairperson Sullivan called the Johnson County Board of Supervisors to order in the Johnson County Health and Human Services Boardroom at 9:00 a.m. Members present: V Fixmer-Oraiz, Jon Green, Lisa Green-Douglass, Royceann Porter, and Rod Sullivan.
All actions were taken unanimously.
Motion by Green-Douglass, second by Porter, to approve the claims on the Auditor’s Claim Register for May 30, 2024.

AMENDING THE FISCAL YEAR 2024 JOHNSON COUNTY BUDGET
Summary: The Board has held a public hearing pursuant to Chapter 331, Code of Iowa, to amend the Fiscal Year 2024 County Budget; and the explanation of changes is as follows:
EXPENDITURES & OPERATING TRANSFERS OUT INCREASED FOR:
Public Safety & Legal Services service area for the departments of Ambulance, County Attorney’s Office, County Sheriff’s Office, Medical Examiner, General Basic Grants, and Rural Basic increased for operating expenses ($70,049)
Physical Health & Social Services service area for the departments of Public Health, Board of Supervisor’s Office, SEATS/Fleet, General Basic Grants, GuideLink Center, Social Services, and Veterans Affairs increased for operating expenses ($210,215)

After consideration of all comments at said hearing the Board determined it will be necessary to amend the Fiscal Year 2024 County Budget and the amendment does not increase taxes to be collected in the fiscal year ending June 30, 2024. RESOLUTION NO. 05-30-24-03
DESIGNATING FUNDS TO BE TRANSFERRED FROM THE AMERICAN RESCUE PLAN ACT FUND TO THE STANDARD ALLOWANCE AMERICAN RESCUE PLAN ACT FUND IN THE FY2024 BUDGET
Summary: It is desired to transfer the designated standard allowance portion and all of the accumulated interest revenues earned from the balances of the American Rescue Plan Act monies since the time of their receipt, so these funds may be segregated from the remaining balance of the more restrictive American Rescue Plan Act Fund monies. Board Action: Resolved that the Auditor is authorized to make periodic transfers from the American Rescue Plan Act Fund to the Standard Allowance American Rescue Plan Act Fund during the 2024 fiscal year as funds are needed and available, not to exceed the sum of $11,884,929. Motion by Porter, second by Fixmer-Oraiz, to approve Resolution No. 05-30-24-03 effective May 30, 2024.
Motion by Porter, second by Green-Douglass, to approve the Capital and Maintenance Improvement Plan for County Facilities and Properties for Fiscal Years 2025-2029, as contained in the agenda packet of this meeting, effective May 30, 2024.
RESOLUTION NO. 05-30-24-04
RESOLUTION TO ESTABLISH A COUNTY MUNICIPAL HOUSING PROGRAM TO ASSIST IN PROVIDING AFFORDABLE HOUSING AND TO FIX A DATE FOR A PUBLIC HEARING ON A GENERAL OBLIGATION COUNTY PURPOSE LOAN AGREEMENT IN AN AMOUNT NOT TO EXCEED $2,250,000 TO FINANCE FUNDING OF PROGRAMS TO ASSIST IN PROVIDING AFFORDABLE HOUSING
Summary: The Code of Iowa authorizes counties to establish housing programs and enter into loan agreements and borrow money for the purpose of funding programs to provide for or assist in providing for the acquisition, restoration, or demolition of housing (the “Essential County Purpose”). The Board proposes to establish a program to provide for the acquisition, restoration or demolition of affordable housing within the County (the “Johnson County Municipal Housing Program”). The Board proposes to enter into a loan agreement (the “Essential County Purpose Loan Agreement”) in an aggregate principal amount not to exceed $2,250,000, for the purpose of paying the costs of the acquisition and restoration of a multifamily affordable housing apartment building. Board Action: Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:
Section 1. The establishment of the Johnson County Municipal Housing Program is hereby approved by this Board.
Section 2. The Board shall meet in Room 203 B/C, Johnson County Health and Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, on June 13, 2024, at 5:30 p.m., at which time and place hearings will be held and proceedings will be instituted and action taken to enter into the Essential County Purpose Loan Agreement.
Section 3. The County Auditor is hereby directed to give notice of the proposed action on the Essential County Purpose Loan Agreement, setting forth the amount and purpose thereof, the time when and place where the said meeting will be held, by publication at least once and not less than 4 nor more than 20 days before the meeting, in a legal newspaper of general circulation in the County.
Section 4. The Essential County Purpose Loan Agreement notice shall be substantially as follows:
NOTICE OF PUBLIC HEARING ON LOAN AGREEMENT
IN A PRINCIPAL AMOUNT NOT TO EXCEED $2,250,000
(GENERAL OBLIGATION ESSENTIAL COUNTY PURPOSE)
The Board of Supervisors of Johnson County, Iowa, will meet in Room 203 B/C, Johnson County Health and Human Services Building, 855 South Dubuque Street, Iowa City, Iowa, on June 13, 2024, at 5:30 p.m. for the purpose of instituting proceedings and taking action to enter into a loan agreement (the “Essential County Purpose Loan Agreement”) in a principal amount not to exceed $2,250,000 for the purpose of paying costs, to that extent, of the acquisition and restoration of a multifamily affordable housing apartment building, including but not limited to restoration of HVAC systems, water heaters and other structural and safety restoration (the “Project”).
The Essential County Purpose Loan Agreement is proposed to be entered into pursuant to authority contained in Sections 331.402, 331.441, 331.443 and Chapter 403A of the Code of Iowa, 2023, as amended, (the “Code”) and will constitute a general obligation of the County.
At that time and place, oral or written objections may be filed or made to the proposal to enter into the Essential County Purpose Loan Agreement. After receiving objections, the Board of Supervisors may determine to enter into the Essential County Purpose Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.

Section 5. The County proposes to undertake the previously referenced project and to make original expenditures with respect thereto prior to the issuance of reimbursement bonds, and reasonably expects to issue reimbursement bonds for all or a portion of the project in the maximum principal amount shown above and hereby declares such project expenditures be permitted to be reimbursed pursuant to Section 1.150-2(f)(2) of the Regulations.
Section 6. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.
Section 7. This Resolution and all documents related hereto or referenced herein may be executed, entered into as provided for pursuant to and in accordance with the Uniform Electronic Transactions Act, Chapter 554D of the Code of Iowa.
Motion by Fixmer-Oraiz, second by Green-Douglass, to approve Resolution No. 05-30-24-04 effective May 30, 2024. At the suggestion of the County Attorney’s Office, Sullivan recited the title of the resolution prior to the Board’s vote.
Motion by Green, second by Porter, to approve the Johnson County 2023 Affordable Housing Report, and recommend pursuit of housing projects that foster achievement of the Report’s recommendations, including acquisition of suitable property or properties within Johnson County presently under consideration.
Motion by Fixmer-Oraiz, second by Porter, to approve the proposed Johnson County Ordinance Authorizing Director of the Johnson County Ambulance Service to Bill for Services and Collect Unpaid Amounts Due from Patients on first consideration.
